TRANSFER PRICING (TP) refers to intercompany pricing arrangements for the transfer of goods, services and intangibles between associated persons.
Recently, the Malaysian Inland Revenue Board (IRB) has issued a new requirement relating to TP in the Corporate Income Tax Return Form (Form) for 2014. IRB Malaysia is now making TP one of its priority areas of tax compliance with the amendment of the Malaysian tax laws to address transfer pricing regime.
The preparation of contemporaneous TP documentation has become a mandatory requirement and there would be fines for failure to do so. This seminar provides an overview of IRB’s guidance on TP documentation and how it applies to businesses. Participants will be briefed on the extent of documentation required and how to comply with the documentation requirements.
Dividend distribution to shareholders, director must now be aware of the new solvency requirement. The company must be able to meet its debts for 12 months after the pay-out of the dividends. If there is a breach of this new solvency requirement, the directors then face the risk of personal liability, both under criminal action and civil action.
